These Terms of Service (“Terms”) govern your access to and use of the web and mobile service for listening to internet radio and related features (the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. About the Service

• The Service aggregates links to third‑party radio stations, provides search/navigation, a player, favorites, and additional features (including temporary stream proxying for compatibility and stability).
• The Service does not own or host radio content unless explicitly stated otherwise.
• Telegram login (including Mini App) may be used for identification, and donations can be made via Telegram Stars; TON is optionally supported.

2. Age

The Service is intended for users aged 16+. If you are under 16, use the Service only with parental consent. Some stations may contain 18+ content; you are responsible for your selections.

3. Account and Authentication

• Login is via Telegram. You must provide accurate data and comply with Telegram’s rules.
• You are responsible for your device/session security. Losing access to your Telegram account may result in losing access to your data in the Service.

4. Content Sources and Rights

• Streams are provided by third parties. All rights belong to their respective owners.
• We do not control broadcast content and do not guarantee legal compliance in your country, absence of advertising, metadata accuracy, availability, or quality.

5. Stream Proxy

• To improve compatibility, reduce latency, and handle technical issues (e.g., CORS/codec/TLS), the Service may temporarily proxy a stream.
• Proxying is not intended to bypass paywalls/DRM or rightsholder restrictions. To prohibit proxying your stream, contact us, and we will promptly apply an exception.

6. Acceptable Use

Prohibited:

• Using the Service unlawfully;
• Circumventing technical protection measures (DRM, geo‑blocks, etc.);
• Overloading/attacking infrastructure (DoS, unrestricted scraping/scanning);
• Re‑broadcasting streams commercially without permission;
• Uploading malware or attempting unauthorized access.

We may restrict/block access upon violations.

7. Donations (Telegram Stars/TON)

• Donations via Telegram Stars and optionally TON are voluntary; they are not payment for services and do not guarantee features or availability.
• Fees and exchange rates are set by third‑party platforms/services (Telegram, blockchains, etc.).
• Refunds: generally non‑refundable. In exceptional cases, contact support. Stars follow Telegram rules; TON transactions are final on the blockchain.

8. Privacy and Data

• We process minimal data required to operate: technical logs, user ID (Telegram), settings, country (if available), listening history, and telemetry.
• See our Privacy Policy for details. By using the Service, you acknowledge processing under applicable law (including GDPR, if applicable).

9. Disclaimer

The Service is provided “as is” and “as available” without warranties. We do not guarantee uninterrupted operation, error‑free performance, device compatibility, station availability, or non‑infringement of third‑party rights in broadcasts.

10. Liability

To the extent permitted by law, we are not liable for indirect/incidental/punitive damages; loss of data, profits, goodwill; failures in third‑party networks/servers/software; broadcast content or third‑party actions. Aggregate liability is limited to €10 or your donations over the last 12 months (whichever is lower).

11. Notices and Takedown (DMCA / Copyright)

Rightsholders may send removal requests including:

1. Rightsholder identification and authority proof;
2. Exact URL/ID of the alleged content/stream;
3. Description of rights and grounds for the claim;
4. Legal address/contacts and email;
5. Good‑faith statement.

12. Termination

We may suspend or terminate access upon violations or by request of rightsholders/authorities. You may stop using the Service at any time.

13. Changes

We may update these Terms. Material changes will be announced in the interface/site. Continued use after changes means acceptance.

14. Governing Law and Jurisdiction

Wyoming law and applicable US federal law (including DMCA). Disputes: courts in Wyoming or agreed arbitration (US). For EU/France consumers: your mandatory consumer/data‑protection rights remain unaffected (GDPR/ePrivacy/CNIL practices apply).
